Expunctions may be filed if a client is found not guilty or if the case is not filed or is dismissed for reasons other than a successful completion of probation. However, a Class C misdemeanor case successfully concluded by deferred adjudication is expungeable.

The usual fee including filing fees is $700 if a contested hearing is not required.

This process normally takes about four months from filing to completion.
